This website is operated by OKOMOYA Wellness. Throughout this document, the terms 'we', 'us' and 'our' refer to OKOMOYA Wellness. By visiting our site and/or purchasing from us, you agree to be bound by these Terms of Service and all policies referenced herein. These Terms are governed by the laws of the Republic of South Africa, including the Consumer Protection Act 68 of 2008 (CPA) and the Protection of Personal Information Act 4 of 2013 (POPIA).

You may not use our products or services for any unlawful purpose or in violation of any applicable law. A breach of these Terms will result in immediate termination of your access to our services.

We reserve the right to refuse service to any person for any lawful reason. Credit card and payment information is encrypted during transmission. You agree not to reproduce, resell, or exploit any part of our website or services without our express written permission.

Section 3 - Accuracy of Information

We make reasonable efforts to ensure that product descriptions, pricing, and availability information on our website are accurate. Where errors occur, we reserve the right to correct them. We are not liable for typographical errors, but we will not enforce a price that was listed in error to your material detriment. Your rights under the CPA are not affected by this clause.

Prices are subject to change without notice. We reserve the right to modify or discontinue products or services at any time. We will not be liable to you for any such modification, suspension, or discontinuation, except as required by the CPA.

Section 5 - Products and Services

Certain products are available exclusively through our online store and may have limited quantities. We have made reasonable efforts to display product colours and images accurately; however, monitor display settings may vary. We reserve the right to limit quantities and to refuse orders that appear to be placed for resale purposes.

Section 6 - Billing and Account Information

You agree to provide accurate and complete purchase and account information. We reserve the right to cancel orders where billing or account information is found to be inaccurate or fraudulent. Where an order is cancelled by us, we will notify you and process a full refund within 7 business days.

We may provide access to third-party tools (such as payment gateways and courier platforms). These tools are provided 'as is'. We are not responsible for the performance or terms of third-party services. Your use of such tools is at your own discretion and subject to the relevant third-party's terms.

Your personal information is collected and processed in accordance with our Privacy Policy, available at www.okomoya.co.za/privacy-policy, and in compliance with the Protection of Personal Information Act 4 of 2013 (POPIA).

We collect personal information (name, email, delivery address, payment details) solely for the purpose of processing your orders and communicating with you about your purchases. We do not sell your personal information to third parties. You have the right to access, correct, or request deletion of your personal data by contacting us at info@okomoya.co.za.

Section 11 - Errors and Omissions

We reserve the right to correct any errors or inaccuracies on our website at any time, including after an order has been submitted. Where a pricing error materially affects your order, we will contact you before proceeding.

You may not use our website or services for any unlawful, abusive, fraudulent, or harmful purpose, including but not limited to: infringement of intellectual property rights; harassment or discrimination; transmission of malicious code; or misrepresentation of identity.

Section 13 - Disclaimer of Warranties and Limitation of Liability

To the extent permitted by South African law, our liability for any claim arising from your use of our products or services is limited to the value of the product or service purchased. Nothing in these Terms limits your rights under the Consumer Protection Act 68 of 2008, including your right to receive goods that are of good quality, safe, and fit for purpose.

You agree to indemnify OKOMOYA Wellness against any claims, losses, or damages arising from your breach of these Terms or your violation of any applicable law or third-party rights.

Section 15 - Severability

If any provision of these Terms is found to be unlawful or unenforceable, that provision will be severed and the remaining Terms will continue in full force.

Section 16 - Termination

We may terminate your access to our services at any time if you breach these Terms. Obligations arising before termination will survive.

Section 17 - Entire Agreement

These Terms, together with our Refund Policy, Shipping Policy, and Privacy Policy, constitute the entire agreement between you and OKOMOYA Wellness in relation to your use of our website and services.

Section 18 - Governing Law and Dispute Resolution

These Terms are governed by the laws of the Republic of South Africa. Any disputes arising from these Terms or your purchase from us shall first be referred to us for resolution at info@okomoya.co.za. If a dispute cannot be resolved directly, you may refer it to the National Consumer Commission (NCC) at www.thencc.org.za or 0860 266 786, or to the applicable Ombud with jurisdiction over the matter.

Section 19 - Changes to These Terms

We reserve the right to update these Terms at any time. Changes will be posted on this page with an updated effective date. Continued use of our website after changes are posted constitutes acceptance of the revised Terms.
